Malaysia : Manufacturers DON'T KNow the LAW & Regulations - OSHA 1994, USECCH REG 2000, CLASS REG 2013
The laws are already in place in Malaysia regulating the manufacturing and use of chemicals. However, some manufactures are not familiar with Malaysian laws and Regulations hence obtaining the SDS from these manufactures can be very challenging, to say the least. A majority of chemicals can be bought at the counter of hardware shops in Malaysia. The salesmen manning the counters at these shops do not know what a SDS is. This lack of awareness is very disturbing. Why is this so?
Firstly, many manufactures think SDS is a private and confidential document and if its revealed it will jeopardise their business. They are ignorant of the fact that SDS is for the benefit of the end user of their product. It is also a legal requirement to make the SDS public and available for end users. In fact the SDS should be made available to anyone who is at the sales counter of the hardware shops!
Secondly, Original Equipment Manufacturers (OEM) manufacture the goods and sell them to another company which then sells it to its customer using its own logo. In this situation, the OEM does not furnish the SDS to the buyer of its product. This is another issue that needs to be addressed.
If we look further into this SDS issue, we will find that most CHRA Assessments are not accurate simply because the SDS are difficult to obtain.
Any industries with the use, handle and store Chemical Hazardous to Health must perform CHRA as required by the LAW. The basis for CHRA is to have the correct SDS for all the chemicals.

In Malaysia particularly, most CHRA assessment are not accurate simply because the SDS are difficult to obtain. Most often than not, SDS are looked upon on the internet, where it will be totally wrong in their composition.
